1. About Us

Glammery is a product and brand owned and operated by Kshiti Software Solutions ("we", "us", or "our"), a company registered in India. By using the Glammery mobile application or website (collectively, the "Platform"), you agree to these Terms & Conditions.

2. Eligibility

You must be at least 18 years old and a practicing beauty professional or business owner to use Glammery. By creating an account, you confirm that the information you provide is accurate and complete.

3. Your Account

You are responsible for maintaining the confidentiality of your account. Glammery uses OTP-based authentication — you are responsible for keeping your registered phone number secure. Notify us immediately at [email protected] if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:
  • Use the Platform for any unlawful purpose
  • Upload false, misleading, or harmful content
  • Attempt to reverse engineer, hack, or disrupt the Platform
  • Use the Platform to spam or harass clients or other users
  • Resell or sublicense access to the Platform

5. Subscription, Payments, WhatsApp & Marketplace Policy

Glammery offers free and paid subscription plans, alongside premium add-ons/top-ups.
5.1 Payment Gateway for Android (Razorpay): All subscription fees, charges, and manual top-up payments initiated on Android devices are securely processed through our integrated payment gateway partner, Razorpay. By submitting payment details, you authorize Razorpay to process payments on our behalf and agree to abide by their standard customer terms of service.
5.2 Payment Gateway for iOS (Apple In-App Purchases): All subscription fees, charges, and manual top-up payments initiated on iOS devices are securely processed through Apple's In-App Purchase system. All transactions, billing, and renewals are governed exclusively by Apple's standard App Store terms, and payments are charged directly to your Apple ID account. You can manage or cancel your subscription at any time within your Apple ID account settings.
5.3 Refund & Cancellation Policy: All subscription payments, premium plan fees, and message top-ups are strictly non-refundable and non-transferable under any circumstances. You can cancel your paid subscription at any time. Upon cancellation, your subscription will remain active with complete access to benefits until the end of your current billing period. For subscriptions purchased via Apple In-App Purchases, cancellation, billing management, and any refund requests must be handled directly through your Apple ID account and are subject to Apple's standard App Store billing policies.
5.4 WhatsApp Quotas & Fair Usage: Paid tiers include a monthly quota of automated WhatsApp messages (powered by MSG91). Unused messages do not roll over to the subsequent billing month. You are solely responsible for acquiring extra message packs or top-ups if you exceed your monthly quota. We reserve the right to temporarily suspend WhatsApp sending privileges if we detect unusual spam, high client rejection/opt-out rates, or system abuse.
5.5 Communication Consent: By creating an account, you consent to receive account verification OTPs, subscription alerts, status updates, and transactional notifications via WhatsApp and SMS. Furthermore, by utilizing our booking and enquiry features to send automated updates to your clients, you represent and warrant that you have obtained explicit consent from your clients to send them booking confirmations, deposit links, and reminders via WhatsApp.
5.6 Marketplace Bookings & Client Disclaimer: While Glammery provides a public marketplace platform for clients to discover and book verified makeup artists, we act strictly as a technology platform provider. Kshiti Software Solutions does not guarantee, warrant, or promise that listing your profile in the Glammery marketplace will result in any client inquiries, bookings, lead generation, or business revenue. You acknowledge that client acquisition is independent of the platform's service availability.

6. Your Data, Content & Client Information

You retain ownership of all data and content you upload to Glammery (client records, portfolio photos, business information). By uploading content, you grant Kshiti Software Solutions a limited license to store, process, and display it solely for the purpose of providing the Platform to you. We do not sell your data to third parties.
6.1 Data Processing Addendum (DPA) & Legal Compliance: Under applicable data protection laws (including the Indian Digital Personal Data Protection Act, 2023), you (the Artist/MUA) act as the Data Fiduciary for all client personal data uploaded or processed on the Platform. Kshiti Software Solutions acts strictly as a Data Processor on your behalf.
6.2 Artist Responsibility: As a Data Fiduciary, you represent, warrant, and covenant that you have obtained all necessary consents, authorizations, and legal grounds to collect, upload, and process your clients' personal data (including phone numbers, names, and booking details) on the Platform. You agree to indemnify and hold harmless Kshiti Software Solutions against any third-party claims, legal actions, or regulatory penalties arising from your failure to obtain proper consent.
6.3 Portfolio Media Public Display: By uploading portfolio images and showcase galleries to your profile, you consent to make this content publicly visible on our directory and marketplace search results. You warrant that you have the rights to use and display these images and that they do not violate any client's privacy or intellectual property rights.
6.4 Backup & Data Loss Disclaimer: While we perform regular database backups and maintain security measures, Kshiti Software Solutions does not guarantee that your data (including client details, bookings, or notes) will never be lost, corrupted, or deleted due to system failures, database crashes, or technical errors. You agree that you are solely responsible for maintaining independent, offline backups of your client lists, booking schedules, and financial records. We are not liable for any direct or indirect business losses, damages, or claims arising from data loss.

7. Platform Availability & Backup Warranty

We strive to keep Glammery available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for any loss, damage, or business interruption resulting from temporary unavailability of the Platform, system crashes, or data deletion.

8. Intellectual Property

All intellectual property in the Glammery Platform — including the brand name, logo, design, and software — is owned by Kshiti Software Solutions. You may not copy, reproduce, or distribute any part of the Platform without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Kshiti Software Solutions shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination & Service Discontinuation

We reserve the right to manage the availability of the Platform as detailed below:
10.1 Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time from within the app. Upon user-initiated termination, your data will be deleted within 30 days as per our Privacy Policy.
10.2 Platform Discontinuation & Company Closure: Kshiti Software Solutions reserves the right, in its sole discretion, to modify, temporarily suspend, or permanently shut down the Platform and/or close its business operations at any time, for any reason (including but not limited to business restructuring, sale, acquisition, insolvency, technical issues, or commercial unviability), with or without cause, and without any liability to you.
10.3 Financial Disclaimer on Closure: In the event of a permanent platform shutdown or company closure, all active subscriptions, top-ups, and services shall terminate immediately. You acknowledge and agree that no refunds (pro-rata or full) will be provided for any remaining or unused subscription periods, premium plans, or message quotas/top-ups.
10.4 Data Export & Grace Period: In the event of a planned permanent shutdown, we will make reasonable commercial efforts to notify you in advance (via in-app notification or WhatsApp) to allow you to export or download your business records and client data. Upon the final shutdown/deletion date, all user data, client databases, and records stored on our servers will be permanently deleted, and we shall not be liable for any data loss, disruption, or failure to export data.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via WhatsApp/SMS. Continued use of the Platform after changes constitutes your acceptance.
